简要规则描述：根据《上海市人民政府办公厅转发市规划国土资源局制定的〈关于加强本市经营性用地出让管理的若干规定(试行)>的通知》(沪府办[2015]30号)和《上海市建设用地土壤污染状况调查、风险评估、风险管控和修复效果评估等工作的若干规定》(沪环规[2021]4号)等要求，按照“谁污染谁治理，谁使用、谁负责”以及“全生命周期管理，按阶段监管落实”的原则，土地储备、出让、收回、续期前，土地使用权人(含土地储备机构)应组织完成土壤污染状况调查。

Brief Specification Description: In accordance with the requirements of the Circular of the General Office of the Shanghai Municipal People's Government Forwarding the Several Provisions on Strengthening the Administration of the Transfer of Operational Land in this Municipality (for Trial Implementation) (Hu Fu Ban [2015] No. 30) and the Several Provisions on the Investigation of Soil Contamination Status, Risk Assessment, Risk Control and Remediation Effect Evaluation of Construction Land in Shanghai (Hu Huan Gui [2021] No. 4), and following the principles of “whoever causes pollution shall be responsible for remediation, and whoever uses the land shall be accountable” and “full life cycle management with phased supervision and implementation”, the land use right holder (including land reserve institutions) shall complete the soil contamination status investigation before land reserve, transfer, withdrawal or renewal.

2. Qualification Requirements for Suppliers

(a)满足《中华人民共和国政府采购法》第二十二条规定；

(b)落实政府采购政策需满足的资格要求：（1）落实预留份额措施，提高中小企业在政府采购中的份额，扶持中小企业政策：本项目专门面向中小企业采购，评审时中小企业产品均不执行价格折扣优惠。（2）扶持残疾人福利性单位，并将其视同小微型企业；

(b)Qualification requirements to be met to implement government procurement policies: (1) Measures for implementing reserved shares to increase the share of small and medium-sized enterprises in government procurement and policies supporting small and medium-sized enterprises: This project is exclusively procured from small and medium-sized enterprises. No price discount shall be applied to products provided by small and medium-sized enterprises during evaluation.

(2) Support welfare units for persons with disabilities, which shall be regarded as micro and small enterprises.

(c)本项目的特定资格要求： 1、符合《中华人民共和国政府采购法》第二十二条的规定 2、未被“信用中国”（）、中国政府采购网（）列入失信被执行人、重大税收违法案件当事人名单、政府采购严重违法失信行为记录名单；3、符合《关于对接国际高标准经贸规则推进试点地区政府采购改革的指导意见》（沪财采〔2024〕12号）第17条规定的供应商，不得参加本项目的采购活动；4、须系我国境内依法设立的法人或非法人组织（本项目不接受分公司以自己名义参加采购活动）；5、本项目不接受组成联合体；6、法定代表人或企业负责人为同一人或者存在控股、管理关系的不同供应商，不得参加同一标段磋商。

(c)Specific qualification requirements for this program: (i) Meets the provisions of Article 22 of the Government Procurement Law of the People's Republic of China.
